Information regarding nonresidents assigned to active duty in Texas, Texas residents assigned to active duty out of state and recently discharged Texas residents.

Non-Residents of Texas

Statute: Section 54.058 (b) A person who is an officer, enlisted person, selectee or draftee of the Army, Army Reserve, Army National Guard, Air National Guard, Air Force, Air Force Reserve, Navy, Navy Reserve, Marine Corps, Marine Corps Reserve, Coast Guard, or Coast Guard Reserve of the United States, who is assigned to duty in Texas and the spouse and children of such an officer, enlisted person, selectee or draftee are entitled to register in a state institution of higher education by paying the tuition fee and other fees or charges required of Texas residents, without regard to the length of time the officer, enlisted person, selectee, or draftee has been assigned to duty or resided in the state.

It is the intent of the legislature that only those members of the Army or Air National Guard, or other reserve forces mentioned above be exempted from the nonresident tuition fee and other fees and charges only when they become members of the Texas units of the military organizations mentioned above.

The Military Waiver and a copy of the Military orders showing active duty assignment in Texas must be submitted to apply the waiver to apply the waiver the first time. The waiver must be renewed each semester.

  • If the student or parent/legal guardian (if dependent) is assigned to active duty within the taxing district of Amarillo College and lives in district, the residency classification will be out of state with a waiver of out of state and out of district tuition. 
  • If the student or parent/legal guardian (if dependent) is assigned to active duty in Texas (not within the taxing district of Amarillo College) and either lives in district or out of district, the residency classification will be out of state with a waiver of out of state tuition only.  

The residency classification is based on where the student or parent/legal guardian (if dependent) is assigned to active duty.  Waivers must be completed each semester the student is enrolled. 

Texas Residents

Recently Discharged Veterans

Texas Education Code Sec. 54.058 (i) A former member of the Armed Forces of the United States or the former member’s spouse or dependent child is entitled to pay the tuition fees and other fees or charges provided for Texas residents for any term or semester at a state institution of higher education that begins before the first anniversary of the member’s separation from the Armed Forces if the former member:

  • has retired or been honorably discharged from the military
  • has Texas listed as the home of record on their DD214

A "Texan" is a service member whose "Home of Record" upon entry into the service was Texas and who has not processed a form with the military to change his/her permanent residence to another state.

  • If the home of record is within the Amarillo taxing district, the residency classification will be in district.
  • If the home of record is not in the Amarillo College taxing district, the residency classification will be out of district.

Active Duty Assigned Out of State

A Texan continues to be a resident and is eligible to pay the resident tuition rate at any public institution of higher education in Texas. This is true for Texas service members taking traditional classes while living in Texas and for Texas service members stationed out-of-state or out-of-country who are taking classes through a Texas public institution via some form of distance education.

A Texan's spouse and dependent children, unless they have established or maintained a separate residence from the member, are also Texas residents and are eligible to pay the resident tuition rate at any public institution of higher education in Texas.

Documents to prove Texas residence include:

  1. Official papers from the military indicating Texas as the "Home of Record" at time of entry into service, and
  2. Current leave and earnings statement (LES) showing Texas as permanent address with the military.
