AI Statement

Collusion is defined as “the unauthorized collaboration with another person or by any other means, including artificial intelligence (AI) and computer translators, in preparing work for fulfillment of course requirements.” Using AI like (ChatGPT or Google Gemini) to create a document is considered colluding. The use of Generative Artificial Intelligence on specific assignments is at the discretion of the instructor.

Amarillo College Tutoring for Success Policy:

Tutoring for Success applies to any student whose overall performance in the course falls below 75%. The instructor will create the task in the Student Engagement Portal (Watermark) to direct the student to the appropriate tutoring service, which may be faculty- or SI-led, discipline-specific, and/or general. The tutoring service assigned, the due date for when the tutoring must be completed, and the amount of tutoring required are at the discretion of the instructor. Additionally, the task will alert the student’s success team. Students who do not fulfill the assigned tutoring task may be subject to program- and course-specific penalties that could result in a grade reduction and/or in not being allowed to progress in the course until the tutoring requirement has been satisfied.

Administrative Drop Policy

Students who do not attend class on or prior to the census date will be administratively dropped. Effective Fall, 2016

Student Withdrawal Procedures

Students who wish to withdraw from a course must complete all steps indicated on the Academic Withdrawal Request form by the course withdrawal deadline.

NOTE: Students who are attending Texas institutions of higher education, for the first time fall 2007 and later, may not withdraw from more than six courses during their academic career. This withdrawal limitation does not include dual credit or developmental classes (Senate Bill 1231 Rule 4.10.) Statement on State-Authorized Courses at Amarillo College

For-credit academic and workforce education courses offered at Amarillo College are limited to the course options available in the statewide inventory for two-year public institutions. Courses in the state-authorized lower-division Academic Course Guide Manual and Workforce Education Course Manual have specific descriptions that prescribe course content and may include specific student learning outcomes. The Texas Higher Education Coordinating Board (THECB) maintains and regularly updates these manuals. Amarillo College faculty and leaders ensure that these courses are aligned with THECB guidelines and evaluated based on student performance outcomes. Students enrolled in these courses are expected to engage with and learn course content. According to the AC Board of Regents Policy Manual, "faculty members are entitled to academic freedom in the conduct of research and teaching and are tasked with the associated responsibilities" (DGC). Students are entitled to academic freedom in the classroom, as well, and faculty "must not attempt to force on students a personal viewpoint and must at all times allow diversity of opinion" (Amarillo College Academic Affairs Manual).

Course Description

This course presents fundamental concepts and procedures of civil litigation with emphasis on the paralegal's role. Topics include pretrial, trial and post trial phases of litigation.

Pre-Trial Procedures and Initial Pleadings

• Analyze Procedural Jurisdictions: Determine court jurisdiction (subject-matter and personal) and proper venue for civil actions based on factual scenarios.

• Draft Initial Pleadings: Draft complaints, summons, and civil cover sheets adhering to the relevant Federal Rules of Civil Procedure (FRCP) or state court rules.

• Draft Responsive Pleadings: Prepare answers, affirmative defenses, counterclaims, cross-claims, and motions to dismiss.

• Evaluate Causes of Action and Remedies: Identify elements of civil causes of action and calculate appropriate legal or equitable remedies.

Fact Investigation and Case Management

• Conduct Client and Witness Interviews: Formulate interview plans, gather background facts, and draft witness statements or affidavits.

• Maintain Litigation Hold and Discovery Logs: Implement procedures for preserving evidence, managing dynamic case files, and tracking statutory deadlines on a litigation calendar.

Discovery Operations

• Draft Discovery Requests: Create written discovery tools, including Interrogatories, Requests for Production of Documents, and Requests for Admissions.

• Draft Responses and Objections: Formulate responses to opposing parties' discovery requests while identifying appropriate privileges (e.g., attorney-client privilege, work-product doctrine).

• Manage Electronic Discovery (eDiscovery): Identify processes for collecting, reviewing, and producing Electronically Stored Information (ESI).

• Prepare for Depositions: Draft deposition notices, subpoenas, and deposition outlines, and synthesize deposition transcripts into summaries for supervising attorneys.

Motion Practice, Settlement, and Trial Support

• Draft Pre-Trial Motions: Draft procedural and dispositive motions, including Motions to Compel Discovery and Motions for Summary Judgment, along with supporting legal memoranda.

• Prepare Trial Documents and Exhibits: Assemble trial binders, organize and mark trial exhibits, draft witness lists, and assist with subpoenaing witnesses.

• Outline Settlement and ADR Options: Draft settlement demand letters, release agreements, and explain Alternative Dispute Resolution (ADR) processes like mediation and arbitration.

700 - 800 points = A

600 - 699 points = B

500 - 599 points = C

400 - 499 points = D

Grading

Chapter Quizzes (16) Each weekly quiz is worth 25 points. You have a total of 400 points to earn on your Chapter quizzes. Your quizzes make up 50% of your final grade. 

•           You only have one attempt at each Quiz. Quizzes are open book. 

•           You must complete the Quiz once you open it. You cannot start a Quiz, exit out and come back. Once you exit the Quiz, your grade will be submitted as is.

•           The quizzes are due every Sunday night by 11:59 p.m, according to the Calendar below.

•           There will be NO make-up quizzes given under any circumstances. If you do not complete the quiz by the due date, you will receive a ZERO. 

Assignments (16) Each Assignment is worth 25 points. You have a total of 400 points to earn on your Discussion Assignments. Each Assignment is due each Sunday by 11:59 p.m. (see calendar below). Your assignments make up 50% of your grade. 

•           If your computer crashes or you have technical difficulties, email me immediately, and I will decide on a case-by-case basis the appropriate solution. I highly recommend using Firefox or Google Chrome as your browser. If you consistently have technical problems, I will insist you take the quizzes at one of AC’s computer labs

Attendance

This is a hybrid class but we will meet in person each week and your attendance each week is mandatory. After 3 unexcused absences, you grade will be dropped by one letter. After 6 unexcused absences, your grade will be dropped another letter.  You have 16 assignments and 8 quizzes, so you will be busy each week to complete these tasks. Please set aside time to read the material and complete your quizzes and assignments. I will be monitoring your progress throughout and will answer any questions you have about the material. PLEASE ask me questions about the material.
